Background
The Cocoanuts (1929) is the Marx Brothers' first feature film β produced by Paramount Famous Lasky Corp. at the Astoria studio in Queens, New York and released August 3, 1929. Directed by Robert Florey and Joseph Santley, it stars Groucho, Harpo, Chico, and Zeppo alongside Margaret Dumont, adapted by Morrie Ryskind from the George S. Kaufman / Irving Berlin Broadway musical that ran 218 performances starting December 1925. Made for roughly $500,000 and earning $1.8 million in worldwide rentals, it was among the most commercially successful early talkies. The US 95-year copyright term expired on January 1, 2025, opening the film β and its embedded Irving Berlin score and the underlying 1925 source play β for free use.
The active rights trap is Universal's restoration. NBCUniversal, which inherited Paramount's pre-1948 library through the 1958 MCA acquisition, released a restored 'Marx Brothers Silver Screen Collection' Blu-ray circa 2016. That restoration is a separately copyrightable work and remains protected even though the underlying 1929 film is PD. Anyone ripping or streaming from the Blu-ray is copying Universal's protected restoration, not the PD source. The Internet Archive item (identifier: the-cocoanuts), uploaded from a print predating Universal's restoration work, is the cleanest PD access point. Commercial uses that prominently feature the Marx Brothers' likenesses or personas may additionally implicate state-law right-of-publicity claims from the Marx Brothers estate, which is active in licensing.

The underlying Irving Berlin songs were written for the 1925 Broadway production and are independently PD by term β that term expired January 1, 2021.
